These Terms of Use ("Terms") are a legal agreement between you ("you" or "User") and WhaleScope ("WhaleScope," "we," "us," or "our") governing your access to and use of the WhaleScope mobile application (the "App") and the whalescope.io website (together, the "Service").
By creating an account, downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to create an account or use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. The Service is not directed to, and we do not knowingly collect personal information from, children under the age of 13. If we learn that we have collected personal information from a child under 13, we will delete that information promptly.
WhaleScope is a market-intelligence tool for Polymarket, a third-party prediction market platform. The Service allows you to:
The Service does not place bets, trades, or orders on Polymarket or any other platform on your behalf, and it does not hold, transmit, or have access to your cryptocurrency wallet or funds. All data about "whale" wallets and their trading activity is derived from publicly available blockchain and Polymarket data. The Service does not act as your broker, financial advisor, or fiduciary.
All analyses, scorecards, sentiment summaries, and AI-generated verdicts provided through the Service are for informational purposes only and do not constitute financial, investment, legal, or tax advice, nor a recommendation or solicitation to buy, sell, or hold any position on Polymarket or any other platform. Prediction markets and cryptocurrency-adjacent activities carry substantial risk, including the risk of total loss. You are solely responsible for your own trading and investment decisions, and you should consult a qualified professional before acting on any information provided by the Service. We do not guarantee the accuracy, completeness, or timeliness of any data, analysis, or AI-generated content in the Service.
To use most features of the Service, you must create an account using an email address and password, or by signing in with your Apple ID ("Sign in with Apple"). You are responsible for providing accurate account information, maintaining the confidentiality of your account credentials, and all activity that occurs under your account. Notify us promptly at the contact address below if you suspect unauthorized use of your account. We are not liable for any loss arising from your failure to safeguard your account credentials.
Certain features of the Service (including a limited number of free analyses per month) are available on a free tier; expanded usage requires a paid subscription. Subscriptions purchased through the App are billed through your Apple ID account (via the App Store) using Apple's in-app purchase (StoreKit) system. Subscriptions purchased through the website are billed via Stripe.
As of the effective date of these Terms, the following auto-renewing subscription products are offered through the App:

Current pricing for each subscription is displayed in the App and/or on the App Store product page at the time of purchase, and is confirmed by Apple before you complete a purchase. Prices are subject to change; we will provide notice of any price change as required by Apple's guidelines and applicable law before it takes effect for existing subscribers.
Auto-Renewal. Subscriptions automatically renew for the same duration and at the then-current price unless you cancel at least 24 hours before the end of the current billing period. Your Apple ID account (or, for web purchases, your payment method on file with Stripe) will be charged for renewal within 24 hours prior to the end of the current period.
Free Trials / Introductory Offers. If a subscription is offered with a free trial or other introductory offer, you will be charged the standard subscription price at the end of the trial/introductory period unless you cancel before it ends. Eligibility for introductory offers is determined by Apple based on your App Store account history.
Cancellation. You can cancel your subscription at any time through your device's Settings app (Settings → [your name] → Subscriptions) for App Store purchases, or through your account settings on the website for Stripe purchases. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until then. We do not process App Store subscription cancellations or refunds directly — those are handled by Apple in accordance with Apple's own terms and policies. For Stripe-billed subscriptions, contact us at the address below.
No Refunds. Except as required by applicable law or by Apple's or Stripe's own refund policies, payments are non-refundable, including for partial subscription periods or unused features.
If you upload a screenshot for analysis, you represent that you have the right to submit it and grant us a limited, non-exclusive, worldwide license to process that image solely to provide the analysis feature (including transmitting it to third-party AI providers for text recognition, as described in our Privacy Policy). Do not upload screenshots containing sensitive personal information about yourself or others.

The Service, including its software, design, text, graphics, logos, and the compiled analyses, scorecards, and AI-generated content it produces (excluding underlying public blockchain/market data, which is not owned by us), is owned by WhaleScope or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved.
The Service relies on and links to third-party platforms and data sources, including Polymarket, Apple (App Store, Sign in with Apple, App Attest, push notifications), and others described in our Privacy Policy. We do not control and are not responsible for the availability, accuracy, or content of those third-party services. Your use of Polymarket itself is governed by Polymarket's own terms, which we are not a party to.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY ANALYSIS, SCORECARD, SENTIMENT SUMMARY, OR AI-GENERATED VERDICT WILL BE ACCURATE OR RELIABLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHALESCOPE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR TRADING/INVESTMENT LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, and you consent to personal jurisdiction there.
We may suspend or terminate your account or access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties, or for any other reason at our discretion, including extended inactivity. You may stop using the Service and request deletion of your account at any time by contacting us as described in our Privacy Policy. Sections of these Terms that by their nature should survive termination (including Sections 8, 10, 11, and 12) will survive.
We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms in the App and/or on whalescope.io and updating the "Effective Date" above, and, where required by law, by providing additional notice (such as email or an in-app notice). Your continued use of the Service after the updated Terms take effect constitutes acceptance of the changes.
